Terms of service
The agreement between you and us when you use Overcharged. Plain English, no small print you need a lawyer for.
1. Who we are
Overcharged (servicechargecheck.co.uk) is run by Origin Collective Limited, a company registered in England and Wales (company number 16566341). Registered office: 124-128 City Road, London, EC1V 2NX. You can reach us at hello@servicechargecheck.co.uk.
2. What Overcharged is, and what it isn't
Overcharged reads the service charge documents you upload and gives you an initial assessment: where your service charge may be challengeable, what it could be worth, which points are weak, a suggested plan and template letters you can send yourself.
- It isn't legal advice. We aren't a law firm and aren't regulated by the Solicitors Regulation Authority. The assessment is general information based on your documents and published law and benchmarks.
- There's no guarantee of any outcome. Savings figures are estimates. Whether you get money back depends on your lease, the facts, what your landlord or agent does, and sometimes a tribunal.
- We don't act for you. We never contact your landlord, managing agent or anyone else on your behalf. You decide what, if anything, to send.
- Computers read your documents. Our software, including AI models, reads them and fixed rules make the assessment. It can misread a document. Each finding shows the clause or figure it relies on so you can check it, and you should check before relying on it.
For anything significant, especially before applying to a tribunal, get advice from a leasehold solicitor or the free Leasehold Advisory Service (LEASE).
3. Who can use it
You must be 18 or over and use Overcharged for a property in England. Only upload documents you're entitled to share, such as those for a property you own or have permission to act for.
4. Your account
You need an account to upload documents, so your assessment is saved and you can come back to it. Keep your password private; you're responsible for what happens in your account. You can delete your account, and everything in it, at any time from My properties.
5. It's free
Uploading documents and your full assessment, including the plan and the letters, are free. We may offer other products in future; anything that costs money will say so clearly before you pay.
6. Voluntary contributions
You can choose to contribute towards the cost of running Overcharged, in any amount you like. A contribution is optional, buys nothing and doesn't change your assessment. We're a company, not a charity, so it isn't a charitable donation and Gift Aid doesn't apply. Payments are taken by Stripe; we never see or store your card details. If you contributed by mistake or change your mind, email us within 14 days and we'll refund you in full. See contributions and refunds.
7. Your responsibilities
- Check each finding against your own documents before acting on it or sending a letter.
- Make sure the letters you send are accurate and appropriate for your situation; you send them in your own name.
- Don't upload anything unlawful, or documents you have no right to share.
- Don't misuse the service, for example by trying to access other people's accounts, overloading it, or copying it at scale.
8. Your documents and our content
Your documents stay yours. You give us permission to store and process them only to provide the service, as described in our privacy notice. The assessment, plan and letters we produce for you are yours to use for your own property. The website, software and templates otherwise remain ours.
9. Our liability to you
We take care to make Overcharged accurate and useful, but it's an initial assessment, so we aren't responsible for decisions you make or what happens as a result of acting on it. If we're at fault, our total liability to you is limited to £100.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law doesn't allow us to limit, and nothing affects your statutory rights as a consumer, including under the Consumer Rights Act 2015.
10. Availability and changes
We aim to keep Overcharged running smoothly but can't promise it will always be available or error-free. We may update the service and these terms; if a change materially affects you, we'll tell you before it applies. The version on this page applies from the date above.
11. Complaints
If you're unhappy, email hello@servicechargecheck.co.uk and we'll reply within 5 working days. See also our contact page.
12. Law
These terms are governed by the law of England and Wales, and the courts of England and Wales can hear any dispute. If you live elsewhere in the UK, you can also use your local courts.
